A Power of Attorney (POA) or letter of attorney is a written authorization to represent or act on another’s behalf in private affairs, business, or some other legal matter. The person authorizing the other to act is the principal, granter, or donor (of the power), and the one authorized to act is the agent, donee, or attorney.

GENERAL POWER OF ATTORNEY

This Power of Attorney document is for appointing an attorney to manage the property or other related issues of the executants who are staying abroad. The attorney is given all the powers as a General Power of Attorney to deal with moveable and immovable properties with the power to even sell or dispose off the properties.

Any one wanting to appoint a General Power of Attorney to deal with his moveable and immoveable property in India, when the executants are likely to be absent from India for a reasonable amount of time can use this document.

SPECIAL POWER OF ATTORNEY

A special type of power of attorney that is used frequently is the “durable” Power of Attorney. A durable power of attorney differs from a traditional power of attorney in that it continues the agency relationship beyond the incapacity of the principal. The two types of durable power of attorney are immediate and “springing.” The first type takes effect as soon as the durable power of attorney is executed. The second is intended to “spring” into effect when a specific event occurs, such as the disability of the principal. Most often, durable powers of attorney are created to deal with decisions involving either property management or HEALTH CARE.

Examples include: registering or selling your automobile or house, paying your taxes, shipping your household goods, obtaining medical care for your children, and cashing checks.
